1. The Verizon Wireless Schools Program (“Program”) is open to Parent Teacher Associations, Parent Teacher Organizations, Education Foundations, Athletic Foundations, and other similar organizations that raise funds for K–12 public or private schools (“School Fundraising Organizations” or “SFOs”). The SFO must be a tax-exempt organization described in §501(c)(3) of the Internal Revenue Code, and authorized by the listed school to raise funds for it. The SFO must deliver to
Verizon Wireless a completed Program Enrollment Form signed by an officer, director, or other person authorized by the SFO to bind it, a completed and signed IRS Form W-9, and any other forms Verizon Wireless may reasonably require from time to time. Verizon Wireless retains sole discretion as to whether an SFO may participate in the Program and may also remove an SFO from the Program at any time at its sole discretion.
2. The SFO agrees to use reasonable efforts to promote the Program within the SFO. The SFO agrees to use only materials provided by Verizon Wireless in promoting the Program.
3. Verizon Wireless will pay to each SFO properly enrolled in the Program $25 for each activation that satisfies all of the following requirements: (a) the activation must be a new line of service (renewals or extensions of existing lines of service with Verizon Wireless do not qualify); (b) the new activation must be on a one- or two-year qualifying calling plan; (c) the new line of service must be activated at a Verizon Wireless retail store or, in Southern California, through the Verizon Wireless Representative
listed on the Program flyer (activations at any other locations do not qualify for the Program); (d) the customer must present a Program flyer preprinted with the SFO’s name and organization number at the time of activation; and (e) the new line of service must remain active for a minimum of 30 days.
4. Verizon Wireless’ determination of whether an activation of a new line of service qualifies for payment to the SFO under the Program is final.
5. Verizon Wireless will make one payment to the SFO under the Program for all qualifying activations made during a calendar quarter. Verizon Wireless will endeavor to make such payment within 60 days of the end of the calendar quarter.
6. Verizon Wireless may change the terms and conditions of the Program and may terminate the Program at any time by notifying each participating SFO. After termination, Verizon Wireless will pay each SFO all amounts attributable to qualifying activations occurring before the effective date of termination of the Program.
7. Both parties agree to comply with all applicable laws. SFO acknowledges that it may be required to register with the state in order to participate in the Program, and if not already registered, agrees to do so before distributing Program flyers.
8. Upon 15 business days’ notice in writing, SFO may, during normal business hours, review Verizon Wireless’ financial records to the extent reasonably necessary to verify that Verizon Wireless has paid SFO the correct amount due.
9. The SFO agrees that Verizon Wireless may use SFO’s name in any communications advertising or promoting the Program.
10. Verizon Wireless may provide notice to the SFO by sending written notice by U.S. Mail or email to the address provided by
the SFO on its Program Enrollment Form.
11. SFO is responsible for notifying Verizon Wireless of any changes to the information provided in its Program Enrollment Form. Such changes must be submitted by email to schoolfundraising@verizonwireless.com.
12. The individual signing the Program Enrollment Form (whether manually or electronically) warrants that he or she is authorized to do so on behalf of the SFO named in the Form.
13. The Program is available only to organizations and customers located
in: Arizona, California, Colorado, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky,
Michigan, Minnesota, Missouri, Montana, Nebraska, New Mexico, Nevada, North Dakota,
Ohio, Oregon, Pennsylvania, South Dakota, Utah, Washington, West Virginia, western Wisconsin, Wyoming,
and El Paso, Texas.
